The Applicant attended in person with his wife. The Committee were advised that an agreement had been reached between GMP, The Out of Hours team and the Applicant.

 

The Committee were provided with a copy of the proposed agreed conditions for the variation and written confirmation that the residents who had objected to the application would not be attending the hearing.

 

The Committee heard evidence from the Applicant and his wife and considered their application. They also took into account the written representations provided by the local residents. The Committee also considered the agreement reached between the Responsible Authorities and the Applicant.

 

In reaching its decision the Committee also considered the Council’s Statement of Licensing Policy, the Licensing Act 2003, the Regulations made there under and the Guidance issued by the Secretary of State under Section 182 of that Act and the licensing objectives.

 

Decision

 

To agree the Variation to the Premises Licence for Alfaisal 2, 69 Thomas Street Manchester, M4 1LQ, subject to the following conditions:

 

• Door supervisor shall manage the queue to avoid customers becoming agitated and to reduce the potential for excessive queues.

 

• Door supervisor shall refuse entry to patrons behaving in an antisocial manner.

 

• Clear and legible notices shall be displayed within the premises which shall indicate the normal hours under the terms of the premises license during which licensable activities are permitted.

 

• The door supervisor and staff shall be well trained and regularly monitor and manage the external areas to ensure that customers are not loitering or causing a disturbance to local residents. They shall ask customers to use the premises in an orderly manner. Any rowdy behaviour from people queuing to be served shall not be tolerated.

 

• No deliveries must be made to the premises between 22:00 and 08:00 hours.

 

• The premises shall ensure that staff departing late at night, after the business has ceased trading, conduct themselves in such a manner to avoid causing disturbance to nearby residents.

 

• A log shall be kept at the premises of the times, names and the licence numbers of all licensed door supervisors employed by the premises and made available on request to the police or an authorised officer of the licensing authority.

 

• Litter bins shall be provided at the premises in sufficient capacity to ensure that customers can adequately dispose of any litter.

 

·  On Fridays and Saturdays SIA registered doorstaff shall be employed at the premises from 0100 hours until 0500 hours to assist with the orderly dispersal of customers. When on duty door staff shall wear Hi-Vis jackets.

 

Reasons

 

The Committee after hearing from the Applicant was satisfied that he was a responsible operator and accepted the additional steps he proposed to take to uphold the licensing objectives, in particular the conditions he had agreed with the Police and the Out of Hours team. Decision

 

The Committee agreed to adjourned consideration of the application until 28 January 2019 at 10.00am, under regulation 12 of The Licensing Act 2003 (Hearings) Regulations 2005, to enable the applicant’s legal representative to attend the hearing.
