The Hearing Panel considered a report from the Director of Planning, Building Control and Licensing.

 

The Licensing Officer addressed the Hearing Panel, noting that no objections had been received to the application. Any decision to refuse the application should only be done within the grounds of the legislation. No mandatory conditions for refusal had been met, and it is down to the Hearing Panel to decide if any discretionary conditions for refusal had been met.

 

The applicant’s representative addressed the Hearing Panel, noting that previous Licence renewals for the establishment had all been approved. They noted the impact of the pandemic on the establishment, only being able to be open for the last 6 months. The Licence is sought on the same basis, there are no requests for a variation. They have received no objections and the representative also noted that no mandatory grounds for refusal had been met. The applicant’s representative did not believe any discretionary grounds had been met either. They informed the Hearing Panel that the establishment is well run, and strictly adheres to the Licence conditions.

 

In their deliberations, the Hearing Panel considered the Council policy relating to Sex Establishment venues. They acknowledged that there had been no objections to the renewal. They also acknowledged that no mandatory conditions for refusal had been met and were satisfied that no discretionary conditions had been met either.

 

Decision

 

To grant the renewal application as applied for.

The Hearing Panel considered a report from the Director of Planning, Building Control and Licensing.

 

The Licensing Officer addressed the Hearing Panel, noting that no objections had been received to the application. Exclusion of the Public

The officers consider that the following item or items contains exempt information as provided for in the Local Government Access to Information Act and that the public interest in maintaining the exemption outweighs the public interest in disclosing the information. The Committee is recommended to agree the necessary resolutions excluding the public from the meeting during consideration of these items. At the time this agenda is published no representations have been that this part of the meeting should be open to the public.

Decision

 

To exclude the public during consideration of the following items which involved consideration of exempt information relating to the financial or business affairs of particular persons, and public interest in maintaining the exemption outweighed the public interest in disclosing the information.

The Hearing Panel were advised that all objections to the application had been withdrawn, allowing for the application to go ahead, and therefore there was no requirement for the Hearing.
