Minutes: The Hearing Panel considered a report from the Head of Planning, Building Control and Licensing regarding a new premises licence application for the above premises. In reaching its decision, the Panel considered the written papers of the parties submitted and the oral representations of the parties who attended, as well as the relevant legislation.
The Applicant and co-Director of the company attended the hearing as did representatives of the Responsible Authorities who had submitted representations. A local ward councillor who had also submitted a representation about the application attended the hearing.
The Chair conducted the hearing in accordance with the agreed procedure.
The Sub-committee addressed the parties and explained that they had received a Youtube link attached to an email two hours before the hearing was due to start. The link was to a promotional video that the Applicant wished to present at the hearing. Enquiries were made about showing the video but due to IT security measures, the video could not be played.
The Applicant then addressed the Sub-committee and explained that they had applied for a Premises Licence to provide alcohol sales, off the premises, 7 days a week – Monday to Saturday 8am to 11.30pm and on Sunday 10am to 5.30pm. There would be no public access to the premises, with all orders placed online and delivered to the customers’ home address.
The premises would employ only one delivery driver to start with and see how the business progressed. Any customers to the premises would have to make an appointment directly with the Designated Premises Supervisor (DPS) or the Co-Director and relevant checks of their ID would take place before entering into any business talks.
It was stated that the premises may be used for podcasts with one or two guests attending to record shows/episodes there and that no alcohol will be consumed whilst the recordings are taking place.
The Sub-committee was advised that children will not be allowed to enter the premises at any time.
The Applicant confirmed that his Alcohol Wholesale Registration Scheme application to supply alcohol had been received and approved by HMRC.
The Applicant indicated that most of their business would be with other businesses, using an online service to set up deliveries through Amazon by DPD and Royal Mail. The Premises indicated that they would instruct and pay the delivery companies to ensure that age verification checks were carried out.
It was stated that every single retail client would be required to sign a disclaimer to say that they would conduct the necessary checks to ensure that they upheld the Protection of Children from Harm licensing objective.
The Applicant advised that compliance with Challenge 25 policy was one of the conditions that had been agreed with one of the Responsible Authorities and had led to Trading Standards removing their objections.
