The Committee considered the application and the representations made both written and those made orally by all parties at the hearing.  The Committee noted that although the Beech Road Traders Association welcomed the opening of a Coop in the area it was concerned that the operation of the premises would make  alcoholic drinks which could be consumed in external areas of Beech Road including the park and the Green outside the Horse and Jockey more easily available. 

 

The consumption of alcohol by young people in these areas had been a problem in the past and the Traders Association was concerned that the operation of the premises could  make this problem recur.  The Traders Association asked the Committee to impose additional conditions on the licence to minimise the risk of alcohol being consumed in these outside areas.  The Traders also expressed a concern that an increase in footfall in the area would encourage begging outside the premises.  

 

The Committee heard from the applicants legal representative that the premises was to be a convenience store and it was anticipated that alcohol sales would  constitute 15% of it's turnover. The Committee was told that the Applicants have 170 years experience of trading on the High Street  and the Committee heard detail of the Induction and training given to all employees and the policies and procedures adopted in stores. 

 

The Committee also noted that the Applicants gave a commitment to the Committee and Traders Association that they would not display alcohol promotions in the window of the premises however they did not want this to be placed as a condition on the licence.  The Applicants legal representative also stated there was no problem with begging in the area currently and the operation of the premises should not encourage begging.  However should the problem occur the premises would take appropriate steps.

 

The Committee understood and concerns of the Traders Association however the Committee considered that there was no evidence that the operation of the premises with the conditions consistent with the operating schedule if managed robustly would undermine the Licensing Objectives. 

 

The Committee welcomed the commitment by the Applicant not to place posters advertising alcohol promotions in the windows of the premises and hoped that the Traders Association and the Coop could work together in the future towards their common goals. 

 

Decision

 

To grant the application with conditions consistent with the operating schedule.

The Committee considered the content of the application and  representations made and also took into account the oral representations made by the applicant at the hearing.  The Committee considered the applicant to be a  responsible operator and noted that the hours applied for were within those set out in the Ancoats and New Islington special policy.  The Committee therefore was satisfied that granting a licence on these terms the operation of these premises would not undermine the Licensing Objectives.

 

Decision

 

To grant the application as applied for subject also to the additional conditions agreed with GMP and LOOH.
