Minutes:
Consideration was given to a report of the Director of Planning, Building Control and Licensing regarding an application for a New Premises Licence.
The Hearing Panel considered the written papers, oral representations of all parties as well as the relevant legislation, guidance, case law and Manchester City Council statement of Licensing Policy.
The applicant’s agent addressed the Hearing Panel and stated that this application was for a general convenience store incorporating a butcher and bakery along with fresh produce and alcohol sales. The agent explained that the shop space given for alcohol was less than ten percent of the shop floor and that there would be no sales of single cans to prevent street drinkers from making purchases. The agent expressed that the applicant was aware of the Withington Stress Policy but felt that various aspects of the application would add to the area and invited the Hearing Panel to consider whether this application was alcohol led, given that less than ten percent of the shop floor was for alcohol sales.
Responsible Authorities, GMP and LOOH, requested information regarding the DPS and their background and the DPS responded to say that they had some previous experience in this field and were aware of the Licensing Objectives.
A Local Ward Councillor along with residents representing local residents’ groups stated that there were already many issues connected to alcohol sales and use in the area, mentioning a large problem with disturbances and nuisance.
In their deliberations the Hearing Panel felt that the application did not constitute an alcohol led premises and that the attention to detail in terms of proposed sales of alcohol and the hours of sales would meet the standards expected to uphold the Licensing Objectives.
Decision
To grant the application as applied for.
