Application for a New Premises Licence - The Creameries, 406 Wilbraham Road, Manchester, M21 0SD

Minutes:

The Hearing Panel considered a report from the Director of Planning, Building Control and Licensing concerning an application for a New Premises Licence. The Hearing Panel considered the written papers of the parties submitted and the oral representations of the parties who attended, as well as the relevant legislation.

 

The applicant addressed the Hearing Panel, noting that they were experienced operators. The application was for an all-day café/bar. There would be no drinks promotions or regulated entertainment. The premises would be based on food and drink. It was hoped that the application was appropriate to the area of Chorlton.

 

Clarity was sought by the panel’s legal representative that the applicant was happy with the conditions agreed by with the Responsible Authorities. The applicant confirmed that they were, noting their experience in managing the areas in those conditions.

 

The applicant summed up that they had agreed with Licensing Out of Hours to not use the outside area beyond 11.00pm. The remaining objector had concerns regarding noise emanation and requested more restrictive hours than those already in place. The applicant felt that the conditions in place were strong enough to alleviate those concerns.

 

In reaching its decision, the Panel has also considered the Council’s Statement of Licensing Policy, the Licensing Act 2003, the Regulations made there under and the Guidance issued by the Secretary of State under Section 182 of that Act as well as the licensing objectives. The panel were satisfied that the applicant was an experienced and responsible operator.

 

Decision

 

To grant the application for a New Premises Licence subject to the conditions agreed with Licensing Out of Hours.
