The Hearing Panel considered a report from the Director of Planning, Building Control and Licensing concerning an application for a new Premises Licence application. The Hearing Panel considered the written papers of the parties submitted and the oral representations of the parties who attended, as well as the relevant legislation.

 

The applicant, Mr Maqsood attended with his nephew/business employee, Mr Awais and addressed the Hearing Panel. The applicant stated that they had received an email from LOOH which expressed that the delivery drivers used by the premises would be noisy. The applicant countered this, claiming that the business would be using a mix of e-bikes and e-vehicles and that they would train the drivers not to slam doors or chat outside.

 

The applicant’s nephew, Mr Awais, addressed the Hearing Panel and stated that drivers would be well advised and reiterated the comments regarding use of electric vehicles for deliveries. Mr Awais stated that the entrance to the premises was carpeted and that the main entrance door did not bang shut. There were less customers after midnight so less noise associated with the premises again for this reason in the later hours. Mr Awais explained that they ran another premises together in Bury which had hours of 16:00 to 04:00, expressing that the busiest hours were 12:00noon to 01:30. There were many delivery orders coming in from the Blackley area and this had driven the desire to open a store in the area. The shop was very close to the motorway ring road and, subsequently there was a lot of background traffic noise and only 2 or 3 nearby residents. The flat upstairs was owned by the business and was occasionally used as a lay over residence by the staff.

 

Mr Maqsood again addressed the Hearing Panel and stated that he had a video of bad traffic queueing up to the motorway entrance up from the premises and the associated noise was captured on film.

 

The Legal advisor to the Hearing Panel stated that any additional evidence would have to be given the permission of LOOH as the objector to the application.

 

LOOH confirmed that they were permissive of the footage being shown.

 

The applicant showed a video on his phone to the Hearing Panel which backed up his claims.

 

Mr Awais continued, noting that the Bury premises had been open for 10 years and added that the upstairs residences above retail units nearby were all empty.

 

Mr Maqsood concurred, stating that the whole block was empty due to the noise and traffic associated with the motorway.

 

In response to questions, Mr Awais and Mr Maqsood stated between them that:

 

  • They had seen 1 or 2 people around the block of residential units using 1 flat and they are there 7 days a week
  • The hours requested were for delivery drivers to continue making deliveries into the early hours
  • They would be satisfied if there was a request to close the shutters in the early hours
