Minutes:

The Chair agreed to the submission of an item of urgent business relating to an application for New Premises Licence - Chester’s Chicken, 368 Cheetham Hill Road, Manchester, M8 9LS.

The Committee noted that agreement had been reached between the applicant and all parties who had made a representation, so treated the matter as a determination.

 

Decision

 

To grant the application subject to the terms and conditions agreed between the parties.

Application for a New Premises Licence - Chunky Chicken, 789 Rochdale Road, Manchester, M9 5XD

Minutes:

Consideration was given to an application for a New Premises Licence for Chunky Chicken, 789 Rochdale Road, Manchester.

 

The applicant attended the hearing and represented himself and was assisted by an interpreter. The Committee considered the application and the representations made against the application.

 

In reaching its decision the Committee considered the Council’s Statement of Licensing Policy, the Licensing Act 2003, the Regulations made there under and the Guidance issued by the Secretary of State under Section 182 of that Act and the licensing objectives.

 

During the evidence it was very clear that the Applicant did not understand what so ever what the 4 licensing objectives are and how they will be upheld.

 

The Applicant confirmed that the Application had been drafted by an accountant and it was clear to the Committee that the applicant did not understand what has been written in the application.

 

The Committee has to be satisfied that the 4 licensing objectives will be upheld and whilst they appreciate that the premises can operate now until 11.00pm without a licence, the later hours applied for will attract a very different customer, which is likely to include people who are in drink. The Committee has no confidence what so ever this Applicant will be able to

deal with any incidents of crime and disorder or public nuisance were they to arise at the premises.

 

In addition during questioning this Applicant was not able to advise the Committee how many staff would be working at the premises during these late hours. The Committee was very concerned seeing that the applicant has applied to be the premises licence holder.

 

Also the Committee through questioning established that there has been no proper training provided to the staff despite the application stating there would be. Furthermore it became very clear that the Applicant clearly does not have skills to train the staff.

 

The Committee considered the two objections against the application, from local residents which set out the problems they believe will arise if the late hours are granted and the concerns raised by the residents have not been addressed by the Applicant.

 

Decision

 

Refuse to grant the New Premises Application.

 

Reason

 

Therefore the Committee refuse the Application as there is overwhelming evidence that the four licensing objectives will not be up held.

The Committee considered an application for a Temporary Event Notice in respect of the Cobbled Area Outside Velvet Hotel, Restaurant and Bar, 2 Canal Street, Manchester, M1 3HE.

 

The Committee heard the submission for the applicant and representations from objectors to the proposal.

 

In reaching its decision the Committee has also considered the Council’s Statement of Licensing Policy, the Licensing Act 2003, the Regulations made there under and the Guidance issued by the Secretary of State under Section 182 of that Act and the

licensing objectives.

 

The Committee listened very carefully to the representations made by GMP and the

Premises User Steven Frodsham and have taken them into account.

 

The Committee also took into account when making their decision that the Premises

User Steven Frodsham was granted a Temporary Event Notice last year for the same area during the event and there were no issues with how the area was run.

 

The Committee are fully aware that the area is very busy during the pride event and that the area does get congested but there is no evidence presented to the Committee that this outside bar would undermined any of the licensing objectives.

 

The Committee understand that licensed premises should work in partnership with the authorities but the Committee accepted what the Applicant said regarding not discussing this application with the police in light of the application been granted last year.

 

The Committee understand that by granting this application others may follow for the area, however the Committee has to consider each one on their own merits.

 

Decision

 

To grant the Temporary Event Notice, as applied for the period 23 August 2019 – 26 August 2019 (12:00 to 21:00 each day).
