Exclusion of the Public

The officers consider that the following item or items contains exempt information as provided for in the Local Government Access to Information Act and that the public interest in maintaining the exemption outweighs the public interest in disclosing the information. The Committee is recommended to agree the necessary resolutions excluding the public from the meeting during consideration of these items. At the time this agenda is published no representations have been that this part of the meeting should be open to the public.

Minutes:

A recommendation was made that the public is excluded during consideration of the items of business.

 

Decision

 

To exclude the public during consideration of the following items which involved consideration of exempt information relating to the financial or business affairs of particular persons, and public interest in maintaining the exemption outweighed the public interest in disclosing the information.

Application for Sparky's, Adair Street, Street Trader Consent

Minutes:

Preliminary matter

 

The Committee were informed by Licensing Officer that the application was for a street trading consent and not a licence as indicated on the papers. The Committee were also informed of the different statutory consideration for licences and consent.

 

Hearing and discussion

 

The Committee were of the view that the Applicant had not sufficiently considered the suitability of the location in making the application and had then not addressed the objector’s legitimate concerns sufficiently.

 

The Committee accepted the concerns of the objectors as to the proposed location for the mobile unit as being inappropriate. The location had the potential for comprising road safety and obstructing lines of sight in and out of the car park.

 

The Committee were informed that there was already another street trader in the immediate area who was trading in similar goods and had been trading for around 20 years. The Committee were of the view that there was already adequate provision of similar goods in the area that the applicant proposed to trade.

 

The Committee were also concerned that sufficient procedures were not going to be put in place for the storage and disposal of waste from the business with the Applicant commenting that he would take the rubbish it home and put it in the bin he had ordered there.

 

 

Decision

 

To refuse to grant the application.
