Exclusion of the Public

The officers consider that the following item or items contains exempt information as provided for in the Local Government Access to Information Act and that the public interest in maintaining the exemption outweighs the public interest in disclosing the information. The Committee is recommended to agree the necessary resolutions excluding the public from the meeting during consideration of these items. At the time this agenda is published no representations have been that this part of the meeting should be open to the public.

To exclude the public during consideration of the following items which involved consideration of exempt information relating to the financial or business affairs of particular persons, and public interest in maintaining the exemption outweighed the public interest in disclosing the information.

The Hearing Panel considered a report from the Director of Planning, Building Control and Licensing.

 

The Hearing Panel considered the written papers, oral representations of all parties as well as the relevant legislation and guidance.

 

A Licensing Officer gave context to the application, stating that the street trader wished to operate Wednesday to Sunday from 11:00 to 16:30 selling rice, curries, stir fries and dumplings. The Licensing Officer also confirmed that LOOH had removed objections, having met agreements with the street trader.

 

The applicant addressed the Hearing Panel and stated that they were looking to diversify their business, confirming that they operated at weekends on another site in Hulme where they worked with the business who had their own café at this location. The applicant stated that they wished to work with the objector in a similar way and felt that their presence may attract customers to the objectors business.

 

An objector from a local business addressed the Hearing Panel and stated that they had concerns about customers of the street trader using their outside benches and toilets, that the mobile catering unit would take trade away from their business and mentioned concerns of littering in Chorlton Ees as a result of the street trader.

 

In their deliberations the Hearing Panel felt that the nature of both businesses was not similar, that waste issues had been addressed in the agreement met with LOOH and felt it appropriate to grant the Street Trading Consent.

 

Decision

 

To grant the Street Trading Consent.
