Review of a Hackney Carriage Driver Licence and a Private Hire Driver Licence - WA

The Hearing Panel considered the content of the report and the written and oral representations made by the Licensing Unit officer and WAA.

 

The Committee were informed that the driver had a conviction for plying for hire and no insurance from September 2020. The driver denied the offences and stated it was a friend from he took with two other males on a short journey for no payment. However, the driver accepted that the Court convicted him of the offences and apologised to the Committee for having to appear before them.

 

The Committee took the offences of plying for hire and no insurance seriously. The Committee considered the explanation provided by the driver, however the Committee noted that they could not go behind this conviction. The Committee also considered the fact he had a previous conviction which did concern them and noted this was now 8 years ago. The Committee considered their Statement of Policy and Guidelines and noted one of the main purposes of the licensing regime is to ensure the protection of the public and therefore a serious view is taken of offences of this nature. They also noted the conviction date fell within the two-year period for consideration.

 

The Committee was considering revocation of the licence however, in light of the fact that the conviction was now nearly a year ago and the offence itself was over two years ago, with no issues since this time, they felt they could depart form the guidelines and impose a three-month suspension.

 

Decision

 

To suspend WAA Private Hire and Hackney Carriage licences for a period of 3 months.

Review of a Private Hire Driver Licence - MA

The Hearing Panel noted that there was no detailed information received regarding a sexual allegation and it was agreed that the matter needed to be deferred for Licensing Unit Officer to obtain further information in relation to the allegation as the information before the Committee was limited and the driver stated he did not know anything about any allegations.

 

It was confirmed to the driver that the suspension issued by Licensing remains in place.

 

Decision

 

To defer consideration of the application until the next meeting of the Hearing Panel.

Application for a New Private Hire Driver Licence - GK

The Hearing Panel considered the content of the report and the written and oral representations made by the Licensing Unit officer and GK.

 

The Committee considered their Statement of Policy and Guidelines and confirmed they take the offence of drink drinking very seriously however, it was also noted that the convictions were now 6 years ago, and the Applicant’s licence was restored in 2018 not 2020 being 3 years ago.

 

Whilst the offences are still within the guidelines the applicant accepted responsibility for the offences and the Committee accepted this was when he was younger and he had now turned his life around. There have been no driving convictions since his licence was restored and no other convictions. The Committee therefore decided he was now a fit and proper person to hold a licence however, also issued it with a warning as to future conduct due to his previous driving convictions.

 

Decision

 

To grant GK a New Private Hire Driver Licencewith a warning as to future conduct.

DBS Project - Review of a Hackney Carriage Driver Licence - NAC

Minutes:

The Hearing Panel considered the content of the report and the written and oral representations made by the Licensing Unit officer. The applicant did not attend the hearing.

 

The Committee heard from the Licensing officer that the Authority do not have full details of the DBS status for the driver including an up to date DBS certificate. The driver had failed to respond to communication, including letters, emails and telephone calls. As a consequence, and in the interests of public safety, his licence was suspended in June 2021. The driver has now engaged and was in the process of supplying a DBS.

 

The Committee agreed that in the interests of public safety the suspension needs to remain in place until a satisfactory DBS is supplied and checks can be made with the DBS checking service.

 

Decision

1.    To continue with the current suspension, until satisfactory DBS status is established.

2.    Agreed that once confirmation of a satisfactory DBS status is received, officers are authorised to lift the suspension.

DBS Project - Review of a Hackney Carriage Driver Licence - SA

The report of the Head of Planning, Building Control and Licensing is enclosed.

Minutes:

The driver attended the hearing and stated there were issues with his emails which had caused the delay in responding. The Committee heard from the Licensing officer that the Authority do not have the complete details of the DBS status, including his DBS certificate. The driver had failed to respond to the communications sent, including letters, emails and telephone calls, until the suspension notice was issued, the interest of public safety, in June 2021.

 

The driver has now engaged with the DBS procedure and officers are awaiting sight of a copy of the DBS certificate.

 

The Hearing Panel agreed that in the interests of public safety the suspension should remain in place until a satisfactory DBS is supplied and checks can be made with the DBS checking service.

 

Decision

 

1.    To continue with the current suspension, until satisfactory DBS status is established.

2.    Agreed that once confirmation of a satisfactory DBS status is received, officers are authorised to lift the suspension.

The Committee heard from the Licensing officer that the Authority do not have complete details of the DBS status for the driver including an up to date DBS certificate. The driver had failed to respond to communication, including letters, emails and telephone calls. As a consequence and in the interests of public safety, his licence was suspended in June 2021.

 

The Hearing Panel agreed that in the interests of public safety the suspension should remain in place until a satisfactory DBS is supplied and checks can be made with the DBS checking service.

 

Decision

 

1.    To continue with the current suspension, until satisfactory DBS status is established.

2.    Agreed that once confirmation of a satisfactory DBS status is received, officers are authorised to lift the suspension.

DBS Project - Review of a Hackney Carriage Driver Licence and a Private Hire Driver Licence - ZB

The Committee heard from the Licensing officer that the Authority did not have complete details of ZB’s DBS status for the driver including an up to date DBS certificate. The driver had failed to respond to communication, including letters, emails and telephone calls, until the suspension notice was issued, in the interest of public safety, in June 2021.

 

ZB attended the hearing and stated he had not received any of the correspondence until his suspension notification which was forwarded to him as he had now moved address. The applicant had now engaged with the DBS procedure and had a copy of his DBS on his phone through another local authority from April 2021. Officers were therefore still awaiting sight of a hard copy of the DBS certificate and an update from the DBS checking service.

 

The Committee agreed that in the interests of public safety that suspension needs to remain in place until a satisfactory DBS is supplied and checks can be made with the DBS checking service.

 

Decisions

 

1.    To continue with the current suspension, until satisfactory DBS status is established.

The Hearing Panel heard from the Licensing officer that the Authority did not have full details of the DBS status for the driver including an up to date DBS certificate. The driver had failed to respond to that communication, including letters, emails and telephone calls, until the suspension notice was issued, in the interests of public safety, in June 2021.

 

The driver stated he had not received any of the correspondence until his suspension notification. Driver has now engaged with the DBS procedure however officers are still awaiting sight of his DBS certificate and an update from the DBS checking service.

DBS Project - Review of a Hackney Carriage Driver Licence - KA

Committee heard from the Licensing officer that the Authority do not have full details of the DBS status for the driver including an up to date DBS certificate. The driver had failed to respond to the initial communication, including letters, emails and telephone call, as he was out of the country and then isolating. The suspension notice was issued, in the interest of public safety, in June 2021.

 

The driver attended, represented by his union representative, and explained his wife died in January 2021 and he then returned to his home village in Pakistan where there was limited access to the internet and he was unable to return due to Covid and the country being red listed. A DBS from 2019 was then presented by the driver at the Committee and the driver confirmed he has applied for a new DBS and signed up to the checking service. The Licensing Officer confirmed he still needed to verify this and check against the updating service. 

 

The Committee agreed that in the interests of public safety that suspension needs to remain in place until a satisfactory DBS is supplied and checks can be made with the DBS checking service.

 

Decisions

 

1.    To continue with the current suspension, until satisfactory DBS status is established.

DBS Project - Review of a Hackney Carriage Driver Licence - AE

The Hearing Panel heard from the Licensing officer that the Authority did not have full details of the DBS status for the driver, including an up to date DBS certificate.

 

The driver failed to respond to communication, including letters, emails and telephone calls, until the suspension notice was issued, in the interests of public safety, and his licence was suspended, in the interests of public safety, in June 2021.

 

The driver attended the hearing and stated he had not received any of the letter correspondence and had only received an email but was not sure if it was a scam email. He presumed officers has seen his DBS in 2019. The driver has now engaged with the DBS procedure. Officers are therefore still awaiting sight of his DBS certificate and an update from the DBS checking service.

 

The Committee agreed that in the interests of public safety that suspension needs to remain in place until a satisfactory DBS is supplied and checks can be made with the DBS checking service.

The Committee was advised that the item had been withdrawn after the driver had provided a satisfactory DBS certificate and had been signed into the DBS checking Service. Their driver suspension had been lifted and their licence restored.

Committee heard from the Licensing officer that the Authority do not have complete details of the applicants DBS status including an up-to-date DBS certificate. The driver failed to respond to communication, including letters, emails and telephone calls, until the suspension notice was issued, in the interests of public safety the licence was suspended, in the interests of public safety, in June 2021.

 

The applicant attended and stated he had not received the correspondence and licensing had seen his DBS in 2019. Driver provided a copy of his DBS to the Committee. The Licensing Officer confirmed the DBS still needed to be verified and checked against the updating service. 

 

The Hearing Panel agreed that in the interests of public safety the suspension should remain in place until a satisfactory DBS is supplied and checks can be made with the DBS checking service.

Driver attended and provided part of a copy of his DBS to the Committee. He stated licensing officers had seen his DBS in 2019. The Licensing Officer confirmed he still needed to see a full copy of the DBS and verify this and check against the updating service. 

 

The Committee agreed that in the interests of public safety that suspension needs to remain in place until a satisfactory DBS is supplied and checks can be made with the DBS checking service.

The Hearing Panel heard from the Licensing officer that the Authority did not have full details of the DBS status for the driver, including an up to date DBS certificate.

Driver attended and provided a copy of his DBS to the Committee. The Licensing Officer confirmed he still needed to see a full copy of the DBS and verify this and check against the updating service. 

 

The Committee agreed that in the interests of public safety that suspension needs to remain in place until a satisfactory DBS is supplied and checks can be made with the DBS checking service.
