Exclusion of the Public

The officers consider that the following item or items contains exempt information as provided for in the Local Government Access to Information Act and that the public interest in maintaining the exemption outweighs the public interest in disclosing the information. The Committee is recommended to agree the necessary resolutions excluding the public from the meeting during consideration of these items. At the time this agenda is published no representations have been that this part of the meeting should be open to the public.

A recommendation was made that the public be excluded during consideration of the following items of business.

To exclude the public during consideration of the following items which involved consideration of exempt information relating to the financial or business affairs of particular persons, and public interest in maintaining the exemption outweighed the public interest in disclosing the information.

Review of a private hire driver licence: BOA

The Hearing Panel considered the report submitted along with the representations made by The Licensing Unit. The driver did not attend.  The Hearing Panel were made aware that this hearing had been adjourned from 25 February 2020 and were supplied with a copy of an email from the driver’s representative confirming that neither they or their client would be attending the hearing and that BOA did not wish to apply for the licence to be returned.

 

Within the report were details that the driver was alleged to have picked up a passenger without a booking (Ply for Hire), which nullified any insurance for the journey, and that as a result of this journey a serious allegation had been levelled at BOA which had then led to a trial where the driver was acquitted.

 

The Hearing Panel determined that the alleged Ply for Hire in addition to the serious allegation, coupled with the driver’s decision to relinquish their licence, was on balance of probability, satisfactory evidence that they were not a fit and proper person to hold a licence.

 

Decision

 

To revoke BOA’s licence.
