The Hearing Panel noted there were no objections to the application for renewal and neither the mandatory nor the discretionary grounds for refusal were made out.

 

The Hearing Panel was satisfied after considering the application that they could grant the renewal with amended conditions. In making their decision they considered their Sex Establishment Policy Document.

 

Decision

 

To grant the renewal with the amended conditions applied for as follows: -

 

1.    The applicant employs a Performer Compliance Officer on Friday and Saturday nights (and other days which are foreseen to be busy) whose duty is to ensure compliance with conditions on the Sex Establishment Licence. The Compliance Officer will patrol the floor during relevant entertainment. When a Compliance Officer is not on duty this is to be completed by a member of the management team.

 

2.    The applicant maintains a documented system of supervision of performances. Compliance Officer (or managers when Compliance Officer is not required) to complete and maintain a performer compliance log. The log should include any breaches noted and the management’s actions.

 

3.    Compliance Officers to sample CCTV from the previous period of trade, a register is to be maintained holding this information, which will be audited on a regular basis by the Licence Holder. The register will be made available to the licensing authority.
