Minutes: The Hearing Panel considered a report from the Head of Planning, Building Control and Licensing concerning an application for a Temporary Event Notice (TEN) for an event proposed to take place at the Manchester Cathedral, Victoria Street, Manchester, M3 1SX. The Hearing Panel considered the written papers of the parties submitted and the oral representations of the parties who attended, as well as the relevant legislation.
The applicant, Mr Adam Hilton Director of Amos Owens represented himself. Also in attendance were PC Aftab Hussain and PC Alan Isherwood (Greater Manchester Police) and Tracy Hill and Verity Hollinshead (Licensing and Out of Hours Compliance Team).
The Chair conducted the hearing in accordance with the agreed procedure.
The Hearing Panel heard that objections had been received from Greater Manchester Police (GMP) and Manchester Council Licensing and Out of Hours Compliance Team (LOOH) to the granting of the TEN for a small Christmas Market held on 7 November 2024.
The application proposed to put on a Christmas market along Cathedral Street (which was situated on Cathedral land), from the corner with Cathedral Yard to the corner with Fennel Street and would comprise of up to 32 chalets selling high end Christmas gifts, four bars serving warm beverages including a selection of alcoholic drinks and three food outlets, spread across the site for up to 499 people.
GMP attended the hearing and advised the Panel that there were concerns regarding how customers wanting to potentially take alcohol off site would be managed, how public safety would be managed specifically along Cathedral Street and the exact area where the market would be located. LOOH’s concerns related to the lack of a layout plan for the event, how numbers would be monitored and prevented from leaving the site with alcohol and that the applicant did not have a market licence or street trading licence in place to cover the event. In addition, LOOH submitted late representations that concentrated around public safety along Cathedral Street which was a service road and needed to be kept clear of obstructions at all times and a breach by the applicant of conditions attached to previous TEN applications that had been granted, centred around the sale and consumption of alcohol in the delineated area only and being taken away from the licensed area.
LOOH also reported on concerns that had been received by a local Ward Councillor of the proximity of the event to the Cheetham School of music dormitories but the Legal representative to the Panel clarified that only Responsible Authorities could object to a TEN application and that these concerns could not be taken into account by the Panel.
For the reasons set out above, GMP and LOOH requested that the Hearing Panel serve a counter notice to this event.
There were no question by the Panel to either GMP or LOOH in regards to the concerns that they had raised.
