Minutes:

The Hearing Panel noted that the application was agreed by all parties prior to the meeting and was therefore treated as a determination.

 

In reaching its decision the Panel also considered the Council’s Statement of Licensing Policy, the Licensing Act 2003, the Regulations made there under and the Guidance issued by the Secretary of State under Section 182 of that Act and the licensing objectives.

 

Decision

 

To grant the licence.

Consideration was given to a report of the Head of Planning, Building Control and Licensing regarding an application for a Summary Review of a Premises Licence.

 

The Hearing Panel considered the content of the report and agreements reached with the Responsible Authorities and Manchester City Council’s licensing policy. 

 

A spokesperson from GMP confirmed that they were not asking for any conditions to be added to the licence as a consequence of the incident but added that the licence had been modernised in agreement with the PLH and their agent.

 

The agent addressed the Hearing Panel and reiterated the points made at the Representations against Interim Steps hearing held on 19 October 2020 and added that the main concern of the premises was that news headlines had incorrectly stated that the premises had held the wake that led to the incident. The agent requested that the Hearing Panel agree a name change of the premises from The Valley to The Vine in their deliberations.

 

The Hearing Panel accepted that the premises had not arranged or been involved with any organised wake which led to the incident on 2 October 2020 but supported GMP in their review under the circumstances. The Hearing Panel agreed the amended conditions with a change of name and felt that no further action on the premises licence was necessary.

 

Decision

 

To agree to change the name on the premises licence to The Vine and to amend conditions 2,5,7,8,11,12 and 15 as agreed between GMP and the Applicant. No interim steps imposed.
