The Hearing Panel noted that the application was agreed by all parties prior to the meeting and was therefore treated as a determination.
In reaching its decision the Panel also considered the Council’s Statement of Licensing Policy, the Licensing Act 2003, the Regulations made there under and the Guidance issued by the Secretary of State under Section 182 of that Act and the licensing objectives.

Minutes: Consideration was given to a report of the Director of Planning, Building Control and Licensing regarding an application for a Premises Licence Variation.
The Hearing Panel considered the written papers, oral representations of all parties as well as the relevant legislation, guidance and case law.
The applicant’s agent addressed the Hearing Panel and explained that they wished to retail alcohol for one hour more than they were currently licensed for, from 23:00 to 00:00midnight. The agent explained that this was in line with other licensed premises on Burton Road. Mention was made of the timings for waste disposal, which was to cease at 23:00.
A Local Ward Councillor requested a condition that the waste disposal hours be amended to cease at 22:00 and the agent confirmed that this was agreeable.
In their deliberations the Hearing Panel felt that the applicants had implemented appropriate conditions on their application but felt it necessary to include a condition regarding waste disposal in that bins were not to be emptied between 22:00 and 08:00. Also, the Hearing Panel felt it appropriate to add a condition that the telephone number of the DPS be made available at the entrance to the premises and also given to local residents in the immediate vicinity.
Decision
To grant the application as applied for with the added conditions regarding waste disposal and availability of the DPS’s telephone number.
