Minutes: Consideration was given to a report of the Director of Planning, Building Control and Licensing regarding an application for a Personal Licence.
The Hearing Panel considered the written papers, oral representations of all parties as well as the relevant legislation.
A spokesperson for GMP addressed the Hearing Panel and gave a report of the applicant having been convicted for fraud in 2017.
The applicant informed the Hearing Panel that they were looking to add wine as part of their food based business venture and would require a Personal Licence to do so legally. The applicant expressed regret about the incident and admitted that it had been a mistake, stating that they had confessed to the fraudulent activity without any prompting. The applicant also stated that this was an isolated incident.
The spokesperson for GMP stated that the applicant had been honest but that the conviction is active until 2022 and therefore, expressed that it was too soon to consider granting the licence.
The Hearing Panel considered the applicant’s honesty regarding the matter of fraud but felt that insufficient time had elapsed since the conviction.
Decision
To refuse to grant the licence.

In reaching its decision the Panel also considered the Council’s Statement of Licensing Policy, the Licensing Act 2003, the Regulations made there under and the Guidance issued by the Secretary of State under Section 182 of that Act and the licensing objectives.
Decision
To grant the licence.
