The Hearing Panel noted that the application was agreed by all parties prior to the meeting and was therefore treated as a determination.

 

In reaching its decision the Panel also considered the Council’s Statement of Licensing Policy, the Licensing Act 2003, the Regulations made there under and the Guidance issued by the Secretary of State under Section 182 of that Act and the licensing objectives.

 

Decision

 

To grant the application for a new premises licence.

Consideration was given to a report of the Director of Planning, Building Control and Licensing regarding an application for a New Premises Licence.

 

The Hearing Panel heard from the applicant’s representative as to the proposed operations and running of the premises, a small restaurant for 40/50 seated patrons. The representative confirmed that the applicant has held a premises licence for one year at Joel’s Grill and was seeking approval from the Hearing Panel to operate with earlier breakfast hours starting at 08:00 and an alcohol licence. The representative clarified in their presentation that the applicant was aware of the premises sitting within a Cumulative Impact Policy (CIP) zone, stating that they were not looking for a late alcohol licence and that the serving of alcohol to patrons on the premises would cease at 23:30 and the premises would be closed at 00:00 midnight.

 

The Hearing Panel then gave consideration to objections from two Residents Groups. Their contributions were on the grounds that they did not wish for any further licensed premises operating within the CIP zone adding to littering issues and anti-social behaviour problems due to intoxication already prevalent in the area. It was noted by the Hearing Panel that the objectors raised the issue of the premises currently having a sign stating that it was open until 03:00 for cocktails. The two objectors stated that they had no issue with the early breakfast opening times and were supportive of this request.

 

When taking all of the representations into consideration the Hearing Panel concluded that 40-50 people consuming alcohol on the premises would add to the cumulative effect of intoxication and subsequent anti-social behaviour in the CIP zone. The Hearing Panel was also concerned about the signs on the doors of the premises which describe the premises as a cocktail bar and a licensed premises open until 03:00.

 

Decision

 

To grant the variation application for opening hours to commence at 08:00 and to refuse the application for the sale of alcohol on and off the premises.
