The Chair agreed to the submission of four items of urgent business relating to:

 

·         Temporary Event Notice – Q Plus Tropical Taste Restaurant, 1038 Ashton New Road, Manchester; M11 4PE;

·         (New) Premises Licence – Chuan, Canal Street, Manchester, M1 3WD – determination;

·         (New) Premises Licence - Spinningfields Conference Centre, Third Floor, Hardman Square, Manchester, M3 3EB – determination;

·         (Variation) Premises Licence – Embassy Club, Westbourne Grove, Harpurhey, Manchester, M9 4XJ - determination.

Temporary Event Notice - Q Plus Tropical Taste Restaurant, 1038 Ashton New Road, Manchester; M11 4PE

Minutes:

Consideration was given to an application for a Temporary Event Notice (TEN) for Q Plus Tropical Taste Restaurant, 1038 Ashton New Road, Manchester; M11 4PE.

 

The premises user and his partner attended the hearing. An officer from Licensing Out of Hours also attended the hearing.

 

The Committee considered the content of the Temporary Event Notice and the representation of Licensing Out of Hours. The Committee considered it appropriate to issue a counter notice as it was concerned that the premises user had not been complying with the conditions of his licence, in particular the Committee noted that the premises user has continued taking food orders until 00:25 at weekends which has meant food has been served some time later and therefore the opening hours and the hours for late night refreshment have not been complied with. The Committee noted that there have been two complaints since the premises started operating and that the premises is situated in a residential area with residents living above the premises and above the neighbouring commercial units.

 

The premises user was also inconsistent when asked about the number of patrons for the Temporary Event Notice event, initially stating he would comply with the maximum capacity of 40 as per the TEN by employing SIA door staff, however he seemed unsure and unclear as to the number of door staff and later stated between 30-50 people had been invited to the event. 

 

The Committee was therefore concerned about the management of the event particularly if more guests had been invited than could be allowed entry and considered this could cause problems. The Committee was therefore satisfied, taking into account all the circumstances that if the event took place it would be likely to cause a noise nuisance.

 

Decision

 

To issue a counter notice to prevent the event from taking place.
