Application for a Premises Licence Variation for Baytree Restaurant, 1140 Rochdale Road, Manchester, M9 6FQ.

The Committee noted that agreement had been reached between the applicant and all parties who had made a representation so treated the matter as a Determination.

Decision

To grant the application subject to the agreed terms and conditions. 

Application for a Temporary Event Notice for The Brickworks, Basement, Barton Arcade, Manchester, M3 2BJ.

The Applicant failed to attend the hearing and the Committee decided to proceed in their absence. It was confirmed that the Applicant was aware of the hearing date.

The Committee heard from Licensing and Out Of Hours (LOOH) about their concerns as to the safe capacity and the responsible management of the event. They gave details of an event the previous week where the premises sold tickets over their capacity under the premises licence and allowed more people in the venue than acceptable under their current capacity. The Committee also heard there were issues with a large queue at the premises on this night and concerns over the management of the same. They also heard that LOOH had made attempts to contact the PLH about the TEN and any risk assessments they had undertaken including in relation to the use of door staff and had had no response.

The Committee agreed that the application had failed to address how the licensing objectives would be upheld and because the Applicant had failed to attend or respond to any communication from LOOH they were unable to ask any question or have any further information provided as to how the premises intended to operate, during the additional hours applied for, and ensure the licensing objectives were upheld.

Decision

To refuse to grant the application and to issue a counter notice.
