The applicant addressed the Hearing Panel, stating that they currently operate a breakfast café from 7am to 2pm. They wanted to expand the business to food deliveries with alcohol. There were no plans to sell alcohol when open to the public during 7am to 2pm. Alcohol would only be available for delivery and the café would not be open to the public at those times. The applicant stated that they were aware of Challenge 25 and had spoken to delivery companies who would carry out their deliveries regarding their policies. In terms of noise, delivery drivers would only attend the premises when the order was ready to collect. The premises would not have a waiting driver.
In questions from GMP, the applicant stated that they held a personal licence and would carry out staff training. Training would involve not serving alcohol in the café, reminding delivery drivers about Challenge 25 and not serving intoxicated customers. The hours for serving alcohol were to be between 5pm and 6am. This was not on the application form, which stated 10pm to 6am. The applicant accepted their mistake and was informed that the panel could only consider the hours on the application and could not extend the hours. The applicant was offered the opportunity to withdraw the application and resubmit. The applicant confirmed that they were happy to continue. The applicant felt that they were far enough away from residents to not cause a nuisance. The applicant was willing to comply with any conditions suggested by the panel or Responsible Authorities regarding noise but had not put any forward themselves.
From questions of LOOH, the applicant stated that they would follow Challenge 25 and train their staff. The applicant noted that a colleague helped them to complete the application, and the applicant thought they had looked at Manchester’s Statement of Licensing Policy and the model conditions.
In questions from Public Health, the applicant stated that alcohol would be stored in under counter fridges. The applicant stated that it was the responsibility of the delivery drivers to deal with checking ID and proxy sales. The applicant had not thought about whether customers would be able to order alcohol alone or if they had to order food to be able to order alcohol.
In questions from the panel, the applicant stated that an order could not be processed without proof of age being provided. The applicant also clarified that the hours would be 10pm to 3am Monday to Wednesday and 10pm to 6am Thursday to Sunday, not 10pm to 6am as suggested in the application. The applicant stated that they would be willing to consider only selling alcohol to those who ordered food.
