Minutes: The Hearing Panel considered a report from the Directorof Planning, Building Control and Licensing regarding the above application.
The panel was advised that following the circulation of amended conditions, the solicitor representing the applicant had responded that the conditions had not been agreed by the applicant and should not have been circulated. Four of the representations received had been withdrawn, based on the amended conditions. Residents were not able to attend the hearing.
The residents requested the deferral of the application to allow the correct papers to be circulated and allow anyone that had made a representation to be present. The panel was advised that the applicant did not oppose the deferral of the application.

Minutes: The Hearing Panel considered the report from the Directorof Planning, Building Control and Licensing regarding the above application.The written papers and oral representations of the parties who attended were also considered, as well as the relevant legislation. The Chair used the agreed procedure to conduct the hearing.
The applicant’s representatives and an officer from the Premises Licensing Team attended the meeting.
The applicant’s representative informed the panel that the representations received had been addressed and had been withdrawn. The Panel was provided with a copy of the email exchange between the objectors and the applicant’s legal representative to confirm the withdrawal of the representations concerning the arrangements for: · bin storage; · emptying of waste bins; and · refuse collection times.
The Panel was informed that the access gate of the storage area could not be locked due to egress and dispersal arrangements from the premises. A revised schedule was circulated to reflect the agreed changes.
The Chair asked all interested parties withdrew from the meeting room to allow the Panel to consider the application in private.
In the considering the application, the Panel noted that the concerns of the ward Councillors and residents had been addressed within the revised operating schedule. In particular, amendments had been made to the conditions regarding waste collection and storage of bins and although the gate which was of concern to one of the objectors could not be closed/locked, the operating schedule was amended to prevent dispersal following events through this gate. The Committee was satisfied that the objectors concerns had been mitigated and that a licensing granted on these terms should not undermine the licensing objectives.
Decision
To grant the application, subject to the revised operating schedule.
