The Hearing Panel considered a report from the Director of Planning, Building Control and Licensing.  The Hearing Panel also considered the written papers of the parties and the oral representations of the parties in attendance as well as the relevant legislation. 

 

The applicant addressed the Hearing Panel and stated that the premises were currently operating from 11:00 to 23:00 and were looking to extend their hours. The premises had been trading for 12 years and without any anti-social issues, reviews, GMP enquiries or littering problems. The applicant explained that the request was due to the impacts of the pandemic on businesses and the rise in utility bills. Previously, utility bills had taken 23% of the profits from the business but they were to rise to 50% by Autumn/Winter. Also, other trends since the pandemic had become evident, namely that people tend to eat later into the day and 21:00 to 23:00 was the busiest time for the business and the current closing time saw the premises missing out on potential customer purchases. Only one responsible authority, MCC Planning department, had objected on the grounds of residents living above the premises, but the applicant stated that they run a premises next door with the same later hours as requested in this application with no issues having arisen.

 

In responding to a question from the Hearing Panel, the applicant confirmed the requested extension of hours as Monday to Thursday 11:00 to 01:00 and Friday to Sunday as 11:00 to 02:00.

 

A representative from the MCC Planning department did not attend the hearing and their written objections were therefore taken into consideration by the Hearing Panel.

 

In their deliberations, the Hearing Panel considered that the premises had been running for 12 years without any issues and were satisfied that this was a responsible operator who would continue to uphold the licensing objectives into their requested later trading hours.

 

Decision

 

To grant the application as applied for.
