The Hearing Panel noted that the application was agreed by all parties prior to the meeting and was therefore treated as a determination.

 

In reaching its decision the Panel also considered the Council’s Statement of Licensing Policy, the Licensing Act 2003, the Regulations made there under and the Guidance issued by the Secretary of State under Section 182 of that Act and the licensing objectives.

 

Decision

 

To grant the licence subject to agreed conditions.

Consideration was given to a report of the Director of Planning, Building Control and Licensing regarding a New Premises Licence.

 

The Hearing Panel considered the written papers, oral representations of all parties as well as the relevant legislation and guidance.

 

The applicant’s agent addressed the Hearing Panel and confirmed a number of agreements had been met with Local Ward Councillors and residents which had led to the creation of an amended operating schedule. The agent confirmed that agreements had been met separately with LOOH which left a number of local residents’ objections to consider but added that they felt that these objections should be covered by the conditions within the new operating schedule. The new schedule listed conditions by which the licensing objectives would be upheld, adding that the applicants had offered to use the premises as a venue for residents’ meetings and that the hours requested were less than other neighbouring licenced premises.

 

In their deliberations, the Hearing Panel felt that the applicant’s extension of their operating schedule would not breach the licensing objectives and felt that they took residents’ concerns into account. The Hearing Panel therefore felt that the licence should be granted in accordance with the conditions within the amended operating schedule.

 

Decision

 

To grant the licence subject to the amended operating schedule.
