Consideration was given to a report of the Director of Planning, Building Control and Licensing regarding a Premises Licence Variation.

 

The Hearing Panel considered the written papers and oral representations of all parties, as well as the relevant legislation and guidance.

 

The applicant addressed the Hearing Panel, stating that the One Eight Six brand was already operating a venue in the City Centre and was about to open it’s second branch in Didsbury. This venue would be less of a wet-led venture, operating more in the style of a restaurant with live music and entertainment, tailored to suit the Didsbury area. The applicant informed the Hearing Panel that the company had secured a 10 year lease on the premises and then explained details around the application for this variation. The variation was now limited in scope after having initially requested extra hours for the sale of alcohol and live music and entertainment. This had now been scaled back, as the applicants had worked with LOOH and local residents (who had both submitted objections and then came to agreements, although some objections from residents remained). The applicant confirmed that they had now retracted the request for additional hours for alcohol sales and reduced the live music and entertainment element of the variation to add 30 minutes Sunday to Thursday and an extra 90 minutes on Friday and Saturday. In their final comments, the applicant stated that the Supplementary Agenda pack contained extra information on noise mitigation, smoking and door supervision and confirmed that upholding the Licensing Objectives was key to their operations.

 

No objector attended the hearing to address the Hearing Panel and the remaining written objections were therefore considered by The Hearing Panel.

 

In their deliberations, the Panel acknowledged the remaining objections, however, they were satisfied that the applicants had done much to meet with responsible authorities and resident objectors to come to agreements. The Panel were also satisfied that the premises would operate in a manner that would uphold the licencing objectives and considered the amended, scaled down variation agreeable.

 

Decision

 

To grant the application subject to conditions agreed below and with the amended operating hours for regulated live music and entertainment:

  • 23:00 to 23:30 Sunday to Thursday
  • 23:00 to 00:30 Friday and Saturday

 

Conditions

 

CCTV

·         CCTV cameras are located within the premises to cover all public areas including all entrances and exits.

·         The system records clear images permitting the identification of individuals.

·         The CCTV system is able to capture a minimum of 24 frames per second and all recorded footage must be securely retained for a minimum of 28 days.

·         The CCTV system operates at all times while the premises are open for licensable activities.

·         All equipment must have a constant and accurate time and date generation.

·         The CCTV system is fitted with security functions to prevent recordings being tampered with, i.e., password protected.
