The Hearing Panel noted that the application was agreed by all parties prior to the meeting and was therefore treated as a determination.

 

In reaching its decision the Panel also considered the Council’s Statement of Licensing Policy, the Licensing Act 2003, the Regulations made there under and the Guidance issued by the Secretary of State under Section 182 of that Act and the licensing objectives.

Consideration was given to a report of the Director of Planning, Building Control and Licensing regarding an application for a New Premises Licence.

 

The Hearing Panel considered the written papers, oral representations of all parties as well as the relevant legislation and guidance.

 

The applicant’s agent addressed the Hearing Panel and informed them that the applicant had previously requested a transfer of the licence from the current licence holder (also the objector) but that this was not successful. The agent explained that there had been a family dispute, that the company director is a Mr Sabbir, father to both the applicant and objector. The agent expressed that the applicant is entitled to apply for this licence and that, if granted, the family would have to work at resolving the dispute.

 

The objector’s agent addressed the Hearing Panel and stated that the current licence holder had held this position since 2001 and that the current licence holder was seeking a protection order due to feeling threatened and had not attended the hearing for this reason.

 

In their deliberations, the Hearing Panel noted that there were no objections from responsible authorities, residents or Ward Councillors and considered that the family dispute was not a factor for the Hearing Panel to take note of. The Hearing Panel, being aware that allowing this application would not remove the current licence holder, granted the application as applied for.

 

Decision

 

To grant the application.

Consideration was given to a report of the Director of Planning, Building Control and Licensing regarding an application for a New Premises Licence.

 

The Hearing Panel considered the written papers, oral representations of all parties as well as the relevant legislation and guidance.

 

The applicant’s agent had given prior notice that they could not attend, and their submission included in the agenda pack was considered by the Hearing Panel.

 

Two resident objectors attended and addressed the Hearing Panel stating that they had concerns regarding a nearby establishment which was run by the same operator. The objectors expressed concerns around homeless people and drug users loitering outside this other nearby store and felt that the same problems would occur at this location if the licence were granted and asked that the Hearing Panel consider adding conditions to extend the retention of the incident log from 6 months to 12 months and to consider that no single can purchases be allowed after 21:00.

 

In their deliberations, the Hearing Panel noted that there were no objections from responsible authorities or Ward Councillors but felt that the concerns of the local resident objectors were valid and therefore granted the licence subject to the conditions requested by the objectors.

 

Decision

 

To grant the licence with the following conditions:

 

  1. An incident log shall be kept at the premises for at least 12 months, and made available on request to the Police or an authorised officer of the licensing authority which will record the following incidents:

(a) all crimes reported to the venue or by the venue to the Police.

(b) all ejections of patrons

(c) any incidents of disorder

(d) any faults in the CCTV system

(e) any visit by a relevant authority or emergency service.

(f) all refusals of sales of alcohol.

 

  1. That from 21:00 any sales of single beers/ciders cease and only multipack sales to be permitted.

Consideration was given to a report of the Director of Planning, Building Control and Licensing regarding an application for a New Premises Licence.

 

The Hearing Panel considered the written papers, oral representations of all parties as well as the relevant legislation and guidance.

 

The applicant addressed the Hearing Panel and gave context to the application stating that the event was from 13:00 to 19:00 on Saturday 4 September 2021 for a maximum of 9,999 attendees.

 

The Hearing Panel took note of one resident objector’s comments in the agenda pack regarding cycle route 6 which runs through Alexandra Park.

 

In their deliberations, the Hearing Panel noted that the carnival was an annual, cultural event and felt that the licence could be granted without undermining the licensing objectives.
