Consideration was given to a report of the Director of Planning, Building Control and Licensing regarding a new Premises Licence application.

 

The Hearing Panel considered the written papers and oral representations of all parties, as well as the relevant legislation and guidance.

 

The applicant’s representative addressed the Hearing Panel, acknowledging the objections from LOOH, a local Councillor and two local residents. The representative told the Hearing Panel they had been liaising with objectors. In discussions, the applicant realised the main objections centred on the external terrace. To alleviate these concerns, the application has been amended to state that the terrace would close at 11.00pm, except for smokers. This led to the withdrawal of all but one objection, with the representative stating they have been unable to contact the final objector; a local resident. They hoped that the amendment would also satisfy this remaining objector. The applicant’s representative stated that the building work on the site will not be complete until at least 2024. They are applying for the Licence for the developers currently as a client for running the bar and restaurant has not yet been selected. They will transfer the Licence once a client has been selected.

 

In their deliberations, the Hearing Panel acknowledged the remaining objection. However, they were satisfied that the applicant had worked hard to alleviate objector concerns and had been liaising closely with them. The Hearing Panel acknowledged that this work led to the withdrawal of most objections. The Hearing Panel took into consideration the Council’s Statement of Licensing Policy, the Licensing Act 2003, the Regulations made there under and the Guidance issued by the Secretary of State under Section 182 of that Act and the licensing objectives.

 

Decision

 

To grant the new Premises Licence application, as amended to close the external terrace at 11.00pm, save for smokers, every day.
