The Hearing Panel considered a report of the Director of Planning, Building Control and Licensing regarding an application for a Temporary Event Notice.

 

The Hearing Panel noted that an agreement had been reached by all parties prior to the meeting for the premises licence conditions to be imposed on the TEN and were satisfied that a TEN granted on these terms should not undermine the Licensing Objectives.

 

Decision

 

To impose the premises licence conditions on the TEN.

The Hearing Panel considered a report of the Director of Planning, Building Control and Licensing regarding an application for a New Premises Licence.The Panel noted that the application was agreed by all parties prior to the meeting and was therefore treated as a determination.

 

In reaching its decision the Panel also considered the Council’s Statement of Licensing Policy, the Licensing Act 2003, the Regulations made there under and the Guidance issued by the Secretary of State under Section 182 of that Act and the Licensing Objectives.

 

Decision

 

To grant the licence subject to agreed conditions.

Consideration was given to a report of the Director of Planning, Building Control and Licensing regarding a New Premises Licence application.

 

The Hearing Panel considered the written papers, oral representations of all parties as well as the relevant legislation and guidance.

 

The applicant’s agent addressed the Hearing Panel and stated that the applicant had made attempts to reach agreements with all objectors prior to the hearing.

 

No spokesperson representing LOOH attended the hearing.

 

A Licensing Officer confirmed that agreements had now been reached between the applicant and LOOH and circulated copies of the agreements.

 

GMP addressed the Hearing Panel and stated that they were now satisfied with the conditions agreed with LOOH but confirmed an amendment regarding SIA door staff only being required on Friday and Saturday.

 

An objector representing 2 local residents of Regents Court addressed the Hearing Panel and stated that Regents Court housed the only residents on the block and gave mention of noise and disturbance, littering, people vomiting on the street and eating take-away food in the doorway outside the residents’ entrance, informing the Hearing Panel that windows of these residents were directly above the premises.

 

In their deliberations, the Hearing Panel noted that responsible authorities were now satisfied with the proposed conditions and took note of GMP’s amendment regarding employment of SIA door staff at weekend only.

 

Decision

 

To grant the licence subject to agreed conditions with the additional amendment that SIA door staff should be employed on Friday and Saturday from 23:00 to 05:00

Application for a New Premises Licence - Greek Grill House, Great Northern Square, 235 Deansgate, Manchester, M3 4EN pdf icon PDF 337 KB

Consideration was given to a report of the Director of Planning, Building Control and Licensing regarding a New Premises Licence application.

 

The Hearing Panel considered the written papers, oral representations of all parties as well as the relevant legislation and guidance.

 

The applicant’s agent addressed the Hearing Panel and stated that this application was to extend trading hours at the applicant’s catering trailer until 04:00 but stated that they had received a recommendation to cease trading at 02:00 instead, confirming that the applicant was satisfied with this proposal. The agent confirmed that CCTV had been installed on the trailer and that SIA security staff would be employed on Friday and Saturday.

 

During questioning from GMP it became clear that the agent could not refer to the 4 Licensing Conditions but answered questions from GMP and LOOH around staffing and how patrons would be encouraged not to eat any products in Great Northern Square.

 

GMP addressed the Hearing Panel and stated that ceasing trading at 02:00 would be preferable as this application was based in a noise sensitive area with many residents nearby. GMP expressed their concerns around the agent’s misunderstanding around the 4 Licensing Objectives and requested that the Hearing Panel refuse the application.

 

LOOH addressed the Hearing Panel and stated that they had met with the applicant in October to agree an operating schedule but felt that there was not enough detail on this schedule to uphold the Licensing Objectives and also requested that the Hearing Panel refuse the application.

 

During questioning, GMP and LOOH both confirmed that there had not been any issues with the catering trailer’s operations up to the current date.

 

During their deliberations, the Hearing Panel considered that the applicant was already trading on the site without any concerns, that, while the agent could not specify precisely the 4 Licensing Conditions, felt that these conditions were covered in their application and would also be assisted by reducing the terminal hour to 02:00 and adding conditions regarding litter picking and employment of SIA security staff.

 

Decision

 

To grant the licence subject to the following conditions:

 

  • Trading to cease at 02:00
  • Staff to undertake regular litter picking throughout trading hours and at close of business
  • SIA security staff to be on site on Friday and Saturday 23:00 to 02:00
