The Hearing Panel noted that the application was agreed by all parties prior to the meeting and was therefore treated as a determination.

 

In reaching its decision the Panel also considered the Council’s Statement of Licensing Policy, the Licensing Act 2003, the Regulations made there under and the Guidance issued by the Secretary of State under Section 182 of that Act and the licensing objectives.

 

Decision

 

To grant the licence subject to agreed conditions.

Consideration was given to a report of the Director of Planning, Building Control and Licensing regarding a New Premises Licence.

 

The Hearing Panel considered the written papers, oral representations of all parties as well as the relevant legislation and guidance.

 

The applicant was accompanied by a member of a facilities managements company.

The applicant addressed the Hearing Panel and stated that this was an application for late night refreshments from 23:00 to 04:00. The applicant informed the Hearing Panel that they had made enquiries about joining the NiteNet scheme, were making changes to employ further door staff to cover the hours applied for, improvements were scheduled to upgrade the CCTV system and also create an incident log. The applicant also confirmed would train staff in maintaining a queueing system, disorderliness and dispersal. Indoor music would cease at later hours when the venue would become a take away only. The applicant confirmed that they would have a direct contact link with the Great Northern Warehouse and GMP in case of any incidents. The applicant stated that they had made mistakes while operating after the COVID-19 lockdown was lifted but stated that they were willing to work with GMP and LOOH to comply with any conditions necessary.

 

A LOOH representative addressed the Hearing Panel and stated that the applicant’s operating schedule was too vague and gave mention of a number of visits to the premises that required return visits in an attempt to have the premises comply with COVID-19 regulations. LOOH felt that the location of the premises could lead to incidents that would breach the licensing objectives and asked the Hearing Panel to refuse the application.

 

A GMP representative addressed the Hearing Panel and stated that they objected on the grounds of Prevention of Crime and Disorder, the Prevention of Public Nuisance and Public Safety and listed the conditions that GMP felt should be in place to allow the application to be granted.

 

In their deliberations, the Hearing Panel felt that this was a new operator who had took more LOOH visits due to inexperience but felt that they had been willing and able to meet the required agreements. The Hearing Panel felt that the conditions requested by GMP in order to grant the licence should be applied in order for the premises to run responsibly.

 

Decision

 

To grant the licence subject to conditions agreed with GMP.

Consideration was given to a report of the Director of Planning, Building Control and Licensing regarding a New Premises Licence.

 

The Hearing Panel considered the written papers, oral representations of all parties as well as the relevant legislation and guidance.

 

The applicant’s agent addressed the Hearing Panel and stated that the premises would be located in the ground floor commercial space of the building and that the applicant was an experienced operator. The agent explained that this was a small venue for 30 patrons and that the weekend hours requested were less than was required of them in accordance with the Special Policy in effect in Ancoats and New Islington. The agent confirmed that there were no objections from responsible authorities and that four residents had objected, three had been contacted and two had subsequently settled on agreements with the applicant. Of the two remaining objectors one did not reply and the other remained concerned about smokers and the hours applied for in the application.

 

In their deliberations, the Hearing Panel felt that this was a responsible operator and had no concerns in granting the application.

 

Decision

 

To grant the licence subject to agreed conditions.
