Consideration was given to the report of the Director of Planning, Building Control and Licensing regarding a Summary Review of the premises licence at Three Legs of Man, 402 Stretford Road, Hulme, Manchester, M15 4AE, following an Interim Steps review on 6 March 2020.

 

GMP informed the Hearing Panel that an incident of serious crime had occurred at the premises on 29 February 2020 and that the DPS had made no attempt to inform the Police of the matter. GMP explained that the DPS had been questioned at the premises and had not offered any information about the incident. A male was then searched on the premises and found to be in possession of illegal weaponry equipment. GMP were then directed to a nearby area outside the premises where they found further illegal weaponry. On returning to the premises the DPS was questioned again and then gave a full statement. GMP then confirmed that they had requested the removal of the DPS at the Interim Steps hearing and that this had been upheld and the DPS replaced.

 

A local resident addressed the Hearing Panel and gave their account of having been subjected to a violent attack outside the premises. The resident explained that they believed the CCTV evidence of the attack had been deleted by the DPS.

 

A Local Ward Councillor spoke in support of local residents stating that they were aware of other incidents linked to the premises.

 

The respondent’s agent then spoke of the DPS having been in position for 10 years, having a good working relationship with GMP and having a family link to the living quarters on site at the premises. The agent confirmed that an agreement had been reached regarding CCTV being in use outside the premises as well as inside and also as the removal of the DPS. The agent felt that these conditions should be sufficient in addressing any potential future concerns.

 

During discussions it came to light that the DPS had a link to the premises with a business partner.

 

In their deliberations the Hearing Panel had concerns regarding the DPS still having access to the premises and potentially being able to run operations “behind the scenes” and felt that there were several conditions required to update the licence.

 

Decision

 

To remove the DPS from the licence and impose on the licence the conditions agreed between the licence holder and Licensing Out of Hours.

 

To amend condition 4 Annex 2 to state the following:

 

The external and internal CCTV system shall be maintained and operated at the premises and recordings shall be kept available and unedited for a minimum of 31 days.

 

To add the following condition:

 

The DPS is not to be involved in the day to day management of the premises and should not have access to the incident log books, the CCTV system or the training records.

 

To amend the opening hours as follows:

 

Monday to Thursday: 11:00 to 00:30

Friday to Saturday: 11:00 to 01:30
