Consideration was given to the report of the Director of Planning, Building Control and Licensing regarding a Summary Review of the Premises Licence at Indigo, 457-459 Wilmslow Road, Manchester, M20 4AN.

The summary review application was submitted by GMP following an incident at the premises which took place on Thursday 30 January 2020. A subsequent Interim Steps hearing was held on Friday 31 January 2020 where the licence was suspended pending modifications to the existing licence. The application by GMP was made under section 53(B) of the Licensing Act 2003.

The Hearing Panel took into account the representations made by GMP, Licensing Out Of Hours (LOOH), a single representative speaking on behalf of two local residents groups and the DPS/licence holder of Indigo Bar/Club and their appointed legal representative.

The Hearing Panel understood that a very serious incident had taken place at the premises and heard all the assembled representative’s views on Indigo’s history as well as the incident in question.

After hearing all the views on Indigo the Hearing Panel felt certain that Indigo did not have any history of similar, previous incidents and from reading the report and holding discussions during the hearing, the Hearing Panel determined that this had been an isolated incident.

Since the Interim Steps Review on 31 January 2020 the DPS/licence holder had worked with GMP and LOOH to create a set of mutually agreed modifications to the licence in order to ensure the safety of patrons and staff at Indigo and eliminate the threat of any similar occurrence. These modifications were circulated at the hearing and the Hearing Panel gave them their full consideration before confirming their approval. Further to this, the Hearing Panel agreed that the licence suspension placed on Indigo at the Interim Steps Review could now be lifted.

Decision

To agree the conditions within the licence modification and lift the licence suspension.
