Consideration was given to a report of the Director of Planning, Building Control and Licensing regarding an application for a New Premises Licence.

 

The Hearing Panel considered the written papers, oral representations of all parties as well as the relevant legislation.

 

The applicant’s agent addressed the Hearing Panel and explained that the previous objections received from LOOH, GMP and Trading Standards had now all been agreed and confirmed that the remaining objections were from two Local Ward Councillors and local residents. The agent continued and explained that the applicant had previous experience in running licensed premises and confirmed that the sale of alcohol would be off-sales by delivery only which should meet the approval of objectors concerns centred around drunken patrons and litter. The agent gave mention to the ratio of objectors (nine) to the amount of dwellings nearby (1700) and disputed claims of littering in the area arising from this premises, stating that this was not their client and that the applicant has a solid reputation.

 

A Local Ward Councillor sought clarity on the operations of the premises for sit-in customers and the agent confirmed that there would be a maximum of 16 customers sitting in, explaining that this was not currently in use due to Coronavirus restrictions and also confirmed that no alcohol could be purchased with a sit-in meal.

 

The two Local Ward Councillors address the Hearing Panel with their concerns about trading hours, security at the premises, litter and noise from delivery vehicles.

 

In their deliberations the Hearing Panel felt that they could grant the license but had concerns over delivery vehicles disturbing local residents during the early morning hours and therefore felt it necessary to amend the trading hours for deliveries and add other conditions to protect nearby residents from other disturbances.

 

Decision

 

To grant the licence subject to additional conditions.
