The Hearing Panel agreed to take two items as Urgent Business:

 

Premises Licence Variation - The Grasshopper Place, 564 Ashton New Road, Manchester, M11 4RP – determination

 

Premises Licence Conversion - Great Wall Restaurant, 52a Faulkner Street, Manchester, M1 4FH - determination

The Hearing Panel was of the opinion that the applicant had adequately demonstrated in the application form and at the hearing the steps it proposed to take to uphold the licensing objectives. The Hearing Panel was satisfied that the conditions agreed with the responsible authorities would uphold the licensing objectives. The remaining evidence (a written representation from a local resident) made against the application was not sufficient to justify a decision to refuse the application.

 

In reaching its decision the Hearing Panel also considered the Council’s Statement of Licensing Policy, the Licensing Act 2003, the Regulations made there under and the Guidance issued by the Secretary of State under Section 182 of that Act and the licensing objectives.

 

Decision

 

To grant the application with the conditions agreed with Trading Standards, Out of Hours and GMP

The Hearing Panel was of the opinion that the applicant had adequately demonstrated in the application form and at the hearing the steps it proposed to take to uphold the licensing objectives. “For Club/DJ events at least one member of door staff at the entrance to the premises shall wear and use a body camera to record all incidents of disorder and all ejections. All door staff shall wear-hi-vis jackets/vests whilst on duty”. (This was agreed with the responsible authorities at the hearing)

The applicant’s representative, on behalf of the applicant, sought a deferral. He advised the Hearing Panel that one of the partners from the solicitor’s firm acting for the applicant was on holiday and the other partner was due to be in attendance today. The Hearing Panel heard from all the other parties as to whether they objected to the request. The local residents/local resident groups, local Councillor and the Manchester University objected to the deferral and asked for the matter to go ahead. The Licensing Out of Hours Team, Premises Licensing and GMP did not object to the application being deferred.

 

The Hearing Panel asked the applicant’s representative to clarify with his legal representation whether they were ‘en-route to the hearing’ and had got delayed. The Hearing Panel was informed after a call to the office that both partners were away abroad and neither would be attending today.

 

After considering the situation the Hearing Panel decided to defer the matter so the applicant could be represented. The Hearing Panel noted that the premises is not open so there is no prejudice to others in this regard.

 

The Hearing Panel however, do require a full explanation at the next hearing on the 2 March as to why the solicitor was not in attendance at the hearing, especially after hearing from the applicant that he was expecting representation at the hearing.

 

Decision

 

To grant a deferral of the application to a later date.

The Hearing Panel heard from all the parties that an agreement had been reached between all the parties and the Applicant asked the Hearing Panel to grant the application subject to the agreed conditions and amended hours.

 

In reaching its decision the Hearing Panel also considered the Council’s Statement of Licensing Policy, the Licensing Act 2003, the Regulations made there under and the Guidance issued by the Secretary of State under Section 182 of that Act and the licensing objectives.

 

Decision

 

To grant the licence subject to the amended hours and conditions.
