The Hearing Panel agreed to take two items as Urgent Business:

 

New Premises Licence - Bonani Bites, 27 Houldsworth Street, Manchester, M1 1EB – determination

 

New Premises Licence – Malmaison, Pearl Assurance House, 23 Princess Street, Manchester M2 4EN – determination

Consideration was given to a report of the Director of Planning, Building Control and Licensing regarding an application for a New Premises Licence.

 

The Hearing Panel noted that agreement had been reached with both GMP and Licensing Out of Hours Team, (LOOH) and also noted that both had required more stringent conditions with LOOH requesting that the opening times be reduced to 02:00 hours instead of the applied for 05:00 hours.

 

The Hearing Panel noted the objections received from a local resident and Local Ward Councillor. It was noted the basis of those objections were concerning Public Nuisance (noise and littering) and Crime and Disorder, both of which the objectors believed would be caused from late night customers and associated littering from their purchases.

 

The Hearing Panel was satisfied by way of questioning the applicant that they were aware of the licensing objectives noting that the applicant also operated two other premises. The Hearing Panel noted the steps the applicant had implemented and also the more stringent conditions that had been agreed with GMP and LOOH and were subsequently satisfied that the licensing objectives would not be undermined.

 

The Hearing Panel was of the opinion that an additional condition should be imposed in that the applicant should provide a direct telephone number for the premises manager in order that they could be contacted in the event of any issues which local residents and/or Councillors would wish to take up with the premises.

 

Decision

 

To grant the licence with Later Night Refreshment hours of 16:00 – 02:00 with the additional conditions as agreed with Greater Manchester Police and the Council’s Licensing Out of Hours service, (outlined at Appendix 5, Item 4 of the Sub-Committee papers), and also with the following additional condition:

 

“A direct telephone number for the manager of the premises shall be publicly available at all times the premises are open. This telephone number is to be made available to residents in the vicinity.”

The Hearing Panel considered an application for a New Premises Licence for which agreement had subsequently been reached with the Responsible Authorities and could therefore be treated as a determination.

 

In reaching its decision the Hearing Panel also considered the Council’s Statement of Licensing Policy, the Licensing Act 2003, the Regulations made there under and the Guidance issued by the Secretary of State under Section 182 of that Act and the licensing objectives.

 

Decision

 

To grant the application subject to the terms and conditions agreed between the parties.
