Peachy Keens, Unit 3a, The Printworks, Withy Grove, M4 2BS - (new) Premises Licence - determination. Minutes: The Committee noted that the application was agreed by all parties prior to the meeting and was therefore treated as a determination.
In reaching its decision the Committee also considered the Council’s Statement of Licensing Policy, the Licensing Act 2003, the Regulations made there under and the Guidance issued by the Secretary of State under Section 182 of that Act and the licensing objectives.

Minutes: Consideration was given to an application for the variation of a Premises Licence. The Applicant attended the hearing and the Hearing Panel heard representations from the responsible authorities.
In reaching its decision the Committee also have considered the Council’s Statement of Licensing Policy, the Licensing Act 2003, the Regulations made there under and the Guidance issued by the Secretary of State under Section 182 of that Act and the licensing objectives.
The Committee was advised that the parties had agreed the majority of the application but there was one issue regarding the closing time for the outside area on a Friday and Saturday evening. The Out of Hours Team submitted the area should be closed at 11.00pm in-line with the week days and the Applicant requested the outside area is able to stay open until midnight on Friday and Saturday evenings.
The Committee considered the Applicant to be a very responsible operator who clearly demonstrated at the hearing the steps they will take to up hold the licensing objectives in particular the prevention of public nuisance. The Committee also took into account the past history of the premises and noted there had been no issues with the premises.
The Committee when making their decision took into account the area where the premises is situated and whilst there are residents in close proximity, it is a mixed area with numerous commercial premises including late night take-aways. Further the Committee took into account that the premises is situated on a very busy road (A6).
The Committee also took into account that midnight for the outside area was only required on weekend nights and not in the week.

To grant the variation of Premises Licence as applied for. |
