To consider any items which the Chair has agreed to have submitted as urgent.

Minutes:

The Chair consented to the submission of three items of urgent business relating to:

 

·         Temporary Event Notice – Eva, 27 Sackvile Street, Manchester

·         Licence (new) – determination – Bills Restaurant Limited, Unit 3 Hardman Square, Manchester

·         Premises Licence variation – determination - Dixy Chicken, 9 Wilmslow Road, Manchester.

 

The Hearing Panel was advised that the two Temporary Event Notices submitted as urgent business in respect of Turtle Bay, 46-50 Oldham Street, Manchester had been withdrawn.

The applicant’s representative addressed the Hearing Panel and explained that following discussion with the objector to the premises licence variation application, the applicant had withdrawn the application.

Consideration was given to an application for a Premises Licence Variation in respect of The Shiredale, 102 Fernclough Road, Manchester, M9 5UR.

 

The Committee considered all representations at the hearing. The Committee also considered the Council’s Statement of Licensing Policy, the Licensing Act 2003, the Regulations made there under, the Guidance issued by the Secretary of State under Section 182 of that Act and the Licensing Objectives.

 

Decision

 

To agree the variation on amended hours -

 

Opening hours Sunday - Thursday 9.30am  - 12.30am

Alcohol sales Sunday - Thursday 9.30am - 11.30pm

 

Opening hours Friday - Saturday 9.30am - 1.00am

Alcohol sales 9.30am - 12.00am

 

Christmas Eve / Boxing Day New Year's Eve 9.30am - 1.00am (1hr dispersal)

 

Conditions:

 

Amend Condition 9 Annex 3 to "and allow up to 10.pm for bona fide functions"

 

Amend condition 26 - remove (i),(ii) and (iii) and amend (iv) by removing the word "daily" and replacing with the words "as necessary".

The Hearing Panel was informed that a request had been submitted by the applicant for the consideration of the Temporary Event Notice to be deferred for consideration by the Hearing Panel scheduled to take place on 19 August 2019.

 

The Hearing Panel agreed to request.

The Committee considered all representations at the hearing. The Hearing Panel was informed that agreement had been reached between the applicant and all parties that had submitted representations to the application.
