The Hearing Panel noted that the application was agreed by all parties prior to the meeting and was therefore treated as a determination.

 

In reaching its decision the Panel also considered the Council’s Statement of Licensing Policy, the Licensing Act 2003, the Regulations made there under and the Guidance issued by the Secretary of State under Section 182 of that Act and the licensing objectives.

 

Decision

 

To grant the licence subject to agreed conditions.

Consideration was given to a report of the Director of Planning, Building Control and Licensing regarding an application for a Premises Licence Variation.

 

The Hearing Panel considered the written papers, oral representations of all parties as well as the relevant legislation.

 

The applicant’s agent addressed the Hearing Panel and stated that the owners ran other premises in Greater Manchester and were experienced, responsible operators.

The operators were looking to run this premises in line with their other premises (high quality burgers and cocktails establishments). The agent stated that the application was for the supply of alcohol which would be sold until 02:00. This, the agent explained, would allow the operators to retain customers they felt they would otherwise lose to other local venues with later licences, having a current alcohol license up to 23:30.

 

A representative from GMP stated that the venue was within the Withington Stress Area and that there was an understanding within that policy that any request for the sale of alcohol after 23:30 should be refused unless there were any exceptional circumstances. GMP stated that they could not find anything in the operating schedule that would denote exceptional circumstances and requested that the application be refused.

 

A representative from LOOH stated that they had reviewed the licence and felt that the 02:30 closing time was not realistic. LOOH stated, however, that they could agree the application with conditions if the operators would consider serving alcohol until 01:00 and closing at 01:30 Monday to Saturday and serving alcohol until 00:00 and closing at 00:30 on a Sunday.

 

A Local Ward Councillor gave comment stating that any other nearby venues with later alcohol licenses would have had these licences in place prior to the Stress Policy being put in place.

 

Local residents gave their objections (some as part of local community action groups) and all were unanimous in their certainty that the application was not appropriate and showed no exceptional circumstances to allow any deviation from the Stress Policy. The local residents and action group representatives gave clear indications of the ongoing problems of late night disturbances in the area and felt that any further late night alcohol establishments would only add the this problem.

 

In their deliberations the Hearing Panel felt that there were no exceptional circumstances evident within the application and agreed that a further late night licence for alcohol within the Stress Policy area could only exacerbate the ongoing problems experienced by local residents. In reaching these conclusions, the Hearing Panel deemed it inappropriate to depart from the policy and refused to grant the variation.
